Weekend Campouts Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Weekend Campouts website, mobile applications, booking platform, community features, and related services collectively referred to as the “Platform.”
The Platform is operated by Adventure Community Co, doing business as Weekend Campouts (“Weekend Campouts,” “we,” “us,” or “our”).
By creating an account, booking or attending a trip, organizing a trip, signing an electronic waiver, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not use the Platform or participate in a Weekend Campouts trip.
1.About Weekend Campouts
Weekend Campouts provides an online platform through which people can discover, organize, book, and participate in camping trips, outdoor activities, and related social experiences.
Trips may be:
- Organized directly by Weekend Campouts;
- Hosted by an independent trip organizer using the Platform; or
- Offered in cooperation with campgrounds, guides, vendors, transportation providers, or other third parties.
Unless a trip listing specifically states otherwise, Weekend Campouts does not own or operate the campground, public lands, transportation services, rental equipment, food services, or third-party activities used during a trip.
Each trip listing will identify the trip organizer and describe the included services, costs, requirements, and applicable policies.
2.Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to create an account or book a trip.
Participants under 18 may attend only when:
- The applicable trip permits minors;
- A parent or legal guardian registers the minor;
- The minor is accompanied and supervised by an authorized adult; and
- The required parental consents and waivers have been completed.
Weekend Campouts and trip organizers may establish additional age, health, experience, fitness, equipment, or participation requirements for individual trips.
3.User Accounts and Profiles
You may be required to create an account before booking or participating in a trip.
You agree to:
- Provide accurate, current, and complete information;
- Maintain the security of your password and account;
- Keep your contact and profile information updated;
- Upload only photographs and content you have the right to use;
- Notify us promptly if you suspect unauthorized account access; and
- Accept responsibility for activity conducted through your account.
Participants are required to complete their profile, upload a profile photo, and answer required profile questions before booking a trip.
Your profile information may be visible to organizers and other confirmed participants as described in our Privacy Policy.
You may not impersonate another person, create a misleading profile, or allow someone else to use your account to bypass eligibility or booking requirements.
4.Trip Listings
Trip organizers are responsible for providing reasonably accurate information about their trips, including:
- Dates and location;
- Trip capacity;
- Campsite or accommodation arrangements;
- Planned activities;
- Physical or experience requirements;
- What is and is not included;
- Equipment requirements;
- Meal, potluck, or food arrangements;
- Transportation and carpool information;
- Accessibility limitations;
- Pet or minor policies;
- Organizer rules; and
- Trip-specific cancellation terms, when applicable.
Outdoor itineraries are inherently subject to change. Campsite conditions, weather, wildfires, road closures, permit restrictions, participant safety, land-management decisions, and other circumstances may require an organizer to modify an itinerary.
Reasonable itinerary changes do not automatically entitle a participant to a refund when the essential nature of the trip remains substantially available.
5.Bookings and Payment
A booking is not confirmed until:
- Required registration information has been submitted;
- Required acknowledgments have been accepted;
- Payment has been successfully processed, unless the participant is specifically registered as complimentary;
- Any required profile information has been completed; and
- The booking confirmation has been issued.
Prices are shown in U.S. dollars unless stated otherwise.
The total amount presented at checkout may include:
- Trip or participation fees;
- Organizer fees;
- Campsite or lodging costs;
- Platform or service fees;
- Processing fees;
- Taxes;
- Equipment or activity charges; and
- Optional add-ons.
By submitting payment information, you authorize Weekend Campouts and its payment-processing providers to charge the displayed amount.
A temporary authorization, failed transaction, duplicate pending charge, or payment-processing delay does not necessarily mean that a booking has been confirmed.
Payment processing may be provided by Stripe or another third-party payment processor. Your use of payment services may also be subject to that processor’s terms and privacy practices.
6.Cancellation Policy
The cancellation policy displayed during checkout and on the applicable trip page forms part of your booking agreement.
Unless a different cancellation policy is clearly displayed for a specific trip, the following standard cancellation policy applies.
6.1 Twenty-Four-Hour Booking Grace Period
You may cancel a booking within 24 hours after purchase and receive a refund of the trip amount paid, provided that:
- The trip does not begin within the next seven days; and
- Weekend Campouts or the organizer has not already incurred a nonrefundable, participant-specific cost on your behalf.
Payment-processing fees and amounts already paid to nonrefundable third-party suppliers may be deducted where permitted by law.
6.2 Participant Cancellation 30 or More Days Before the Trip
When you cancel at least 30 calendar days before the scheduled trip start date, you may receive a Weekend Campouts account credit for the eligible amount paid, less:
- Payment-processing fees;
- Clearly disclosed platform or booking fees;
- Nonrefundable campsite, permit, vendor, food, rental, or activity expenses;
- Any cancellation charges imposed by third-party suppliers; and
- Any discounts or credits that must be reversed.
Unless otherwise stated, the resulting credit will be valid for 12 months from the date it is issued.
6.3 Participant Cancellation 15–29 Days Before the Trip
When you cancel between 15 and 29 calendar days before the scheduled trip start date, you may receive an account credit equal to 50% of the eligible trip fee after deductions for:
- Payment-processing fees;
- Platform or booking fees;
- Nonrefundable third-party expenses; and
- Other amounts already committed for your participation.
The remaining amount is nonrefundable and will not be issued as credit.
6.4 Participant Cancellation Fewer Than 15 Days Before the Trip
Cancellations made fewer than 15 calendar days before the trip start date are nonrefundable and are not eligible for account credit.
This includes cancellations resulting from:
- Illness or injury;
- Work or family obligations;
- Transportation problems;
- Flight delays or cancellations;
- Traffic;
- Personal emergencies;
- Failure to obtain required equipment;
- Failure to complete required documents;
- A change in personal comfort with the forecast or conditions;
- Arriving late; or
- Deciding not to attend.
Participants are strongly encouraged to purchase travel insurance that covers trip cancellation and interruption for reasons important to them.
6.5 No-Shows and Early Departure
No refund or credit will be provided when a participant:
- Does not arrive;
- Arrives too late to participate;
- Leaves a trip early;
- Misses an activity;
- Is removed for misconduct;
- Fails to bring required equipment;
- Fails to meet a disclosed participation requirement; or
- Chooses not to use an included service.
6.6 Participant Substitutions and Transfers
You may request to transfer your booking to another eligible person no later than 72 hours before the trip begins.
Transfers are subject to:
- Organizer approval;
- Available time to process the transfer;
- Completion of the replacement participant’s profile;
- Completion of all required waivers and acknowledgments;
- Satisfaction of trip eligibility requirements;
- Payment of any price difference; and
- A transfer or administrative fee, if disclosed.
A booking may not be resold, auctioned, or transferred for profit.
The original participant remains responsible until the replacement participant has been approved and the transfer has been confirmed in writing.
6.7 How to Cancel
Cancellation requests must be submitted through the participant’s Weekend Campouts account or emailed to hello@weekendcampouts.com.
A cancellation is effective when it is received through an approved cancellation method. Telling another participant, posting in a discussion thread, or sending a message to an unofficial organizer account does not constitute formal cancellation.
Credits and refunds are calculated based on the date and time the formal cancellation request is received.
6.8 Refund Processing
Approved refunds will generally be returned to the original payment method.
Banks and payment processors control when refunded funds appear in an account. Weekend Campouts is not responsible for financial-institution processing delays.
Account credits:
- Have no cash value;
- Cannot be redeemed for cash;
- May not be sold;
- May be limited to the original account holder;
- May be subject to trip availability; and
- Expire on the date shown when issued, except where prohibited by law.
7.Organizer or Weekend Campouts Cancellations
Weekend Campouts or the organizer may cancel, postpone, relocate, shorten, or materially modify a trip because of:
- Insufficient enrollment;
- Organizer illness or emergency;
- Campground closure;
- Wildfire, smoke, flooding, storms, extreme heat, snow, or other hazardous conditions;
- Road closure or transportation disruption;
- Governmental or land-management action;
- Permit denial or revocation;
- Public-health conditions;
- Supplier failure;
- Safety concerns;
- Force majeure; or
- Circumstances outside reasonable control.
7.1 Trip Cancelled Before It Begins
When Weekend Campouts or the organizer cancels the entire trip before it begins, participants will ordinarily be offered one or more of the following:
- A refund of the recoverable trip amount paid;
- A transfer to a rescheduled departure;
- An account credit; or
- A comparable replacement trip.
The specific remedy may depend on whether campground, permit, vendor, payment-processing, or other third-party costs can be recovered.
Weekend Campouts will not retain amounts that are legally required to be refunded.
7.2 Material Trip Changes
If a trip is materially changed before departure, Weekend Campouts may offer participants the choice of accepting the modified trip or receiving the remedy stated in the trip notice.
Changes to individual activities, meal arrangements, campsite assignments, schedules, trail selections, or comparable itinerary details generally will not be considered a cancellation of the trip.
7.3 Trip Interrupted After It Begins
If a trip must be shortened, relocated, evacuated, or terminated after it begins because of safety concerns or circumstances beyond the reasonable control of Weekend Campouts or the organizer, any refund or credit will be limited to amounts that can reasonably be recovered from third-party suppliers.
No refund is guaranteed for unused portions of a trip after it has begun.
7.4 Participant’s Additional Expenses
Weekend Campouts is not responsible for consequential or incidental expenses resulting from a trip cancellation or change, including:
- Airfare;
- Hotels;
- Rental cars;
- Fuel;
- Rideshare costs;
- Equipment purchases;
- Lost wages;
- Pet care;
- Childcare; or
- Other personal expenses.
Participants should purchase refundable travel arrangements or appropriate travel insurance when making plans around a trip.
8.Weather, Wildfires, Smoke, and Outdoor Conditions
Camping trips take place outdoors and may proceed in rain, wind, cold, heat, smoke, snow, insects, mud, or other uncomfortable conditions.
A weather forecast alone does not mean a trip has been cancelled.
Participants should not assume that a trip is cancelled unless Weekend Campouts or the organizer provides an official cancellation notice.
If the trip remains scheduled and a participant independently chooses not to attend, the participant cancellation policy will apply.
Weekend Campouts and organizers retain discretion to cancel, relocate, evacuate, or modify a trip when they reasonably determine that conditions create an unacceptable safety risk.
9.Activity Waiver and Assumption of Risk
Camping and outdoor activities involve inherent and unexpected risks, including:
- Slips, trips, and falls;
- Uneven or unstable terrain;
- Wildlife and insects;
- Falling rocks, branches, or trees;
- Water-related hazards;
- Fire and cooking hazards;
- Severe or rapidly changing weather;
- Heat exhaustion, dehydration, hypothermia, or altitude illness;
- Allergic reactions;
- Foodborne illness;
- Equipment failure;
- Vehicle accidents;
- Limited cellular service;
- Delayed emergency response;
- Acts or omissions of other participants; and
- Serious injury, illness, property damage, disability, or death.
Each participant must review and electronically sign the applicable Activity Waiver, Release of Liability, and Assumption of Risk Agreement before participating.
The waiver is a separate legal agreement and is incorporated into these Terms by reference.
A participant who does not sign the required waiver may not attend the trip and will be treated as having cancelled under the applicable cancellation policy.
10.Health, Fitness, and Medical Information
You are responsible for determining whether you are physically, mentally, and medically capable of participating in a trip.
Weekend Campouts and trip organizers do not provide medical advice and do not guarantee that a trip is appropriate for any particular person.
You are responsible for:
- Consulting a healthcare professional when appropriate;
- Bringing necessary medications and medical supplies;
- Disclosing information specifically requested for safety or accommodation purposes;
- Managing allergies, medical conditions, dietary restrictions, and mobility needs;
- Carrying adequate water, food, clothing, and equipment; and
- Understanding the remoteness and emergency limitations of the trip location.
Health and dietary information may be requested when an organizer is supplying meals or when the information is reasonably needed for participant safety. It may not be requested for every trip.
Providing information does not guarantee that an organizer can accommodate every medical, accessibility, allergy, or dietary need.
Participants with severe allergies or medical conditions should carry their own emergency medication and safety supplies.
11.Emergency Assistance
In an emergency, you authorize Weekend Campouts, an organizer, or another responsible person to seek medical, evacuation, rescue, or emergency assistance when reasonably believed necessary.
You are financially responsible for medical treatment, rescue, evacuation, transportation, and related expenses incurred on your behalf.
Weekend Campouts does not guarantee the availability or response time of medical, rescue, ranger, fire, law-enforcement, or evacuation services.
12.Participant Conduct
Participants must act responsibly and respectfully toward organizers, other participants, campground personnel, local communities, wildlife, and the environment.
Prohibited conduct includes:
- Harassment, bullying, discrimination, threats, or violence;
- Sexual harassment or unwanted sexual conduct;
- Reckless or dangerous behavior;
- Excessive intoxication;
- Possession or use of illegal drugs;
- Providing alcohol to minors;
- Theft or property damage;
- Disrupting the trip or preventing others from participating;
- Violating fire restrictions, campground rules, laws, permits, or Leave No Trace principles;
- Bringing unauthorized guests, pets, weapons, or hazardous materials;
- Operating a vehicle while impaired;
- Recording others in private situations without consent; or
- Refusing to follow reasonable safety instructions.
Weekend Campouts or the organizer may remove a participant from a trip when reasonably necessary to protect safety, property, the environment, or the trip experience.
A participant removed for misconduct is not entitled to a refund or credit and is responsible for arranging and paying for their own transportation away from the trip.
Serious or repeated violations may result in suspension or permanent termination of the participant’s Platform account.
13.Alcohol and Controlled Substances
Participants of legal drinking age may consume alcohol only when permitted by the organizer, campground, land manager, and applicable law.
Participants are personally responsible for their alcohol consumption and conduct.
Illegal drugs and unlawful controlled substances are prohibited.
Weekend Campouts does not supervise individual alcohol consumption and is not responsible for injuries or damages caused by a participant’s voluntary intoxication or unlawful substance use.
14.Transportation and Carpools
Unless specifically included in the trip listing, transportation is not provided by Weekend Campouts.
Carpool features are offered as a convenience to help participants communicate. Weekend Campouts does not:
- Employ or certify carpool drivers;
- Inspect vehicles;
- Verify driver records, licenses, insurance, or vehicle condition;
- Guarantee transportation;
- Control routes or driving behavior; or
- Assume responsibility for agreements between drivers and passengers.
Drivers and passengers participate in carpools voluntarily and at their own risk.
Drivers are responsible for maintaining a valid license, legally required insurance, a safe vehicle, and compliance with traffic laws.
Any cost-sharing arrangement is solely between the driver and passenger.
15.Potlucks, Meals, and Food
Some trips may include optional potlucks, shared meals, or food supplied by participants, organizers, or third parties.
Unless expressly stated otherwise:
- Weekend Campouts does not inspect participant-prepared food;
- We cannot guarantee ingredient accuracy;
- We cannot guarantee an allergen-free environment;
- Cross-contact may occur;
- Participants are responsible for deciding what they can safely consume; and
- Participants with dietary restrictions should bring suitable food when needed.
Participants preparing food must follow reasonable food-safety practices and accurately disclose known ingredients when asked.
16.Pets
Pets are permitted only when the trip listing or organizer expressly allows them.
Pet owners are responsible for:
- Complying with campground and land-management rules;
- Keeping the pet under control;
- Cleaning up after the pet;
- Preventing excessive noise or aggressive behavior;
- Protecting wildlife and other participants; and
- Paying for any injury or property damage caused by the pet.
Service animals will be addressed in accordance with applicable law.
17.Equipment and Personal Property
Participants are responsible for bringing the equipment identified in the trip listing or packing instructions.
Weekend Campouts does not guarantee the quality, safety, availability, or suitability of participant-owned, organizer-owned, rented, borrowed, or third-party equipment.
You are responsible for your personal belongings. Weekend Campouts is not liable for items that are lost, stolen, damaged, left behind, exposed to weather, or stored in another person’s vehicle.
18.Independent Trip Organizers
Some organizers using Weekend Campouts may be independent users rather than employees, agents, partners, or representatives of Weekend Campouts.
Independent organizers are responsible for:
- The accuracy of their trip listings;
- Obtaining required permits and permissions;
- Following applicable laws and campground rules;
- Conducting trips with reasonable care;
- Communicating material trip information;
- Managing participant safety within the scope of their role;
- Handling trip funds distributed to them;
- Providing any promised organizer-supplied services; and
- Maintaining insurance when required.
Weekend Campouts may establish organizer standards, review listings, process payments, issue communications, or remove organizers. These actions do not necessarily create an employment, agency, partnership, or joint-venture relationship.
Weekend Campouts does not guarantee an organizer’s qualifications, conduct, representations, or performance unless expressly stated in writing.
19.Platform Fees and Organizer Payouts
Weekend Campouts may charge participants, organizers, or both a platform, booking, payment-processing, service, or administrative fee.
Applicable fees will be disclosed before purchase or acceptance of an organizer listing.
Organizer payouts may be:
- Processed through a third-party payment provider;
- Held until specified payout conditions are satisfied;
- Delayed because of disputes, chargebacks, fraud reviews, legal requirements, or payment-provider restrictions;
- Reduced by refunds, fees, taxes, chargebacks, or amounts owed to Weekend Campouts; or
- Reversed when a transaction is refunded or disputed.
Organizers authorize Weekend Campouts and its payment providers to offset amounts owed against future payouts where permitted by law.
20.Chargebacks and Payment Disputes
Before initiating a chargeback, you agree to contact Weekend Campouts at hello@weekendcampouts.com and give us a reasonable opportunity to investigate and resolve the issue.
Submitting a knowingly false, misleading, or fraudulent chargeback may result in:
- Account suspension or termination;
- Cancellation of future bookings;
- Recovery of chargeback costs;
- Collection activity; or
- Other remedies permitted by law.
Nothing in this section limits any lawful right to dispute an unauthorized or incorrect charge.
21.Promotional Credits, Discounts, and Complimentary Bookings
Promotional codes and credits:
- Must be used according to their stated terms;
- May be limited to one per booking;
- May not be combined unless expressly permitted;
- Have no cash value;
- May not be sold or transferred;
- May exclude taxes, fees, or add-ons; and
- May be cancelled if obtained through fraud, mistake, or misuse.
When a discounted booking is cancelled, any refund or credit will be based on the amount actually paid rather than the undiscounted value.
Complimentary participants remain subject to all eligibility, profile, conduct, waiver, and trip requirements.
22.User Content
The Platform may allow users to post photographs, videos, profile information, comments, reviews, messages, trip descriptions, and other content.
You retain ownership of content you create. By submitting content to the Platform, you grant Weekend Campouts a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute that content as reasonably necessary to operate and promote the Platform.
You represent that:
- You own the content or have permission to use it;
- The content does not violate another person’s privacy, publicity, intellectual-property, or contractual rights;
- The content is not defamatory, fraudulent, unlawful, or misleading; and
- Individuals depicted in promotional content have provided any required consent.
Weekend Campouts may remove content that violates these Terms or is otherwise inappropriate for the Platform.
23.Photography and Media
Participants may be photographed or recorded during trips.
Any promotional use by Weekend Campouts will be governed by the photo or media consent presented during registration, in the Activity Waiver, or at the trip.
Participants should respect requests from others who do not wish to be photographed or publicly identified.
You may not photograph or record another participant in a restroom, tent, changing area, medical situation, or other setting where the person has a reasonable expectation of privacy.
24.Intellectual Property
The Weekend Campouts name, logos, website design, software, text, graphics, branding, and original Platform content are owned by or licensed to Weekend Campouts.
You may not copy, reproduce, modify, scrape, sell, publish, reverse engineer, or commercially exploit Platform content without written permission, except as permitted by law.
25.Third-Party Services and Links
The Platform may link to or integrate with third-party services, including:
- Payment processors;
- Mapping services;
- Campground reservation systems;
- Weather services;
- Social-media platforms;
- Transportation providers;
- Travel-insurance providers; and
- Equipment or activity vendors.
Weekend Campouts does not control and is not responsible for third-party websites, services, availability, content, security, policies, or performance.
Your use of third-party services is governed by the terms between you and the applicable provider.
26.Privacy
Our collection and use of personal information are described in the Weekend Campouts Privacy Policy.
By using the Platform, you consent to the collection, processing, and sharing of information as described in that policy.
Trip organizers may receive participant information reasonably necessary to manage a trip, such as names, contact details, profile information, signed-waiver status, and information voluntarily submitted for accommodation or safety purposes.
Organizers may use that information only for legitimate trip-related purposes and must protect it from unauthorized use.
27.Electronic Communications and Signatures
You consent to receive agreements, notices, booking confirmations, trip updates, cancellation notices, disclosures, and other communications electronically.
You agree that electronic acknowledgments, checkbox acceptances, typed signatures, and digitally captured signatures may have the same legal effect as handwritten signatures to the extent permitted by law.
You are responsible for maintaining a current email address and mobile telephone number in your account.
Critical trip communications may be sent by email, text message, Platform notification, or a combination of methods.
Marketing texts will be sent only with the consent required by applicable law. Consent to marketing is not a condition of purchasing a trip.
28.Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WEEKEND CAMPOUTS DOES NOT WARRANT THAT:
- THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE;
- EVERY TRIP LISTING WILL BE COMPLETE OR ACCURATE;
- A PARTICULAR TRIP, ORGANIZER, CAMPGROUND, ACTIVITY, OR CARPOOL WILL MEET YOUR EXPECTATIONS;
- OUTDOOR CONDITIONS WILL BE SAFE, COMFORTABLE, OR PREDICTABLE;
- CELLULAR, INTERNET, MEDICAL, OR EMERGENCY SERVICES WILL BE AVAILABLE; OR
- THIRD-PARTY SERVICES WILL PERFORM AS PROMISED.
Nothing in these Terms excludes warranties or rights that cannot lawfully be waived.
29.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEEKEND CAMPOUTS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, PERSONAL TRAVEL EXPENSES, OR EMOTIONAL DISTRESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEEKEND CAMPOUTS’ TOTAL LIABILITY ARISING FROM A BOOKING OR USE OF THE PLATFORM WILL NOT EXCEED THE AMOUNT YOU PAID TO WEEKEND CAMPOUTS FOR THE SPECIFIC TRIP GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot legally be excluded or limited, including liability based on fraud, willful misconduct, or other nonwaivable conduct.
30.Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Weekend Campouts and its owners, officers, employees, contractors, affiliates, and representatives from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from:
- Your violation of these Terms;
- Your unlawful or negligent conduct;
- Your user content;
- Injury or damage caused by your pet, vehicle, equipment, food, or personal actions;
- Your infringement of another person’s rights; or
- Your misuse of the Platform.
This obligation does not apply to the extent a claim was caused by Weekend Campouts’ own unlawful conduct.
31.Suspension and Termination
Weekend Campouts may restrict, suspend, or terminate an account when we reasonably believe that the user:
- Violated these Terms;
- Created a safety risk;
- Engaged in fraud or payment abuse;
- Harassed another user;
- Misused personal information;
- Repeatedly cancelled or disrupted trips;
- Filed fraudulent disputes;
- Circumvented Platform fees; or
- Exposed Weekend Campouts or others to legal or financial risk.
When appropriate, we may cancel future bookings and apply the applicable cancellation policy.
Provisions that logically should survive termination—including payment obligations, disclaimers, liability limitations, dispute provisions, and intellectual-property protections—will remain in effect.
32.Dispute Resolution
Before filing a formal claim, you agree to send a written description of the dispute to:

The parties will make a good-faith effort to resolve the dispute informally for at least 30 days.
Nothing in these Terms prevents either party from seeking relief in small claims court when the claim qualifies.
Optional Arbitration Provision
Except for eligible small claims and claims seeking urgent injunctive relief, disputes arising from these Terms or the Platform will be resolved through individual binding arbitration administered by [AAA/JAMS] under its applicable consumer rules.
The arbitration will take place in the county where the participant resides, remotely, or at another mutually agreed location.
Claims must be brought individually and not as a plaintiff or class member in a class, consolidated, or representative action, except where this restriction is prohibited by law.
You may opt out of the arbitration provision by sending written notice to [legal email address] within 30 days after first accepting these Terms. The notice must include your name, account email address, and a clear statement that you are opting out of arbitration.
This arbitration section should be reviewed and finalized by a qualified attorney before publication.
33.Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
When a dispute is not subject to arbitration, the parties consent to the state and federal courts located in [Santa Barbara County, California], except where applicable consumer law requires another location.
34.Force Majeure
Weekend Campouts will not be liable for delays, changes, interruptions, or failures caused by events beyond its reasonable control, including:
- Natural disasters;
- Wildfires or smoke;
- Severe weather;
- Floods;
- Earthquakes;
- Epidemics or public-health emergencies;
- War, terrorism, or civil unrest;
- Government orders;
- Campground or public-land closures;
- Utility or communications failures;
- Labor disputes;
- Transportation interruptions; or
- Supplier failures.
This section does not eliminate any refund obligation imposed by applicable law.
35.Changes to These Terms
Weekend Campouts may update these Terms from time to time.
Material changes will be communicated by posting the revised Terms, updating the “Last Updated” date, or providing another reasonable notice.
Changes will apply prospectively unless otherwise permitted by law.
The Terms presented and accepted at the time of booking will generally govern that booking, except for changes required by law or necessary to address an immediate safety or security issue.
36.General Terms
These Terms, the Privacy Policy, the Activity Waiver, the trip listing, and any policies presented during checkout constitute the agreement governing your booking and use of the Platform.
If there is a conflict:
- A written trip-specific term clearly disclosed during checkout controls for that trip;
- The Activity Waiver controls regarding assumption of risk and released claims;
- These Terms control regarding general Platform use; and
- The Privacy Policy controls regarding personal information.
If any provision is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of the right to enforce it later.
You may not assign your rights under these Terms without our written consent. Weekend Campouts may assign these Terms as part of a merger, reorganization, asset transfer, or similar business transaction.
Headings are included for convenience and do not limit the meaning of any provision.
